Wiretap suits OKd against U.S., not telecoms

sfgate.com

The nation's telecommunications companies can't be sued for cooperating with the Bush administration's secret surveillance program, but their customers can sue the government for allegedly intercepting their phone calls and e-mails without a warrant, a federal appeals court ruled Thursday.
In a pair of decisions, the Ninth U.S. Circuit Court of Appeals in San Francisco upheld a 2008 law immunizing AT&T and other companies for their roles in wiretapping calls to alleged foreign terrorists, but revived a suit that accused the government of illegally intercepting millions of messages from U.S. residents.
That lawsuit was partly based on testimony in 2003 by former AT&T technician Mark Klein about equipment in the company's office on Folsom Street in San Francisco that allowed Internet traffic to be routed to the government.

'Dragnet' surveillance

The Electronic Frontier Foundation, a privacy-rights organization representing AT&T customers, claimed the company had similar installations in other cities and used them for "dragnet" surveillance of everyday e-mails and phone calls, which the National Security Agency purportedly screened electronically for connections to terrorism.
"We look forward to proving the program is an unconstitutional and illegal violation of the rights of millions of ordinary Americans," said Cindy Cohn, the foundation's legal director.
Justice Department spokesman Dean Boyd declined comment.

U.S. spy agency trying to go mobile

Linkreuters.com

(Reuters) - Troy Lange knows that just mentioning cellphones is enough to give security officers heartburn at the National Security Agency.

Lange, as the NSA's mobility mission manager, is developing a smartphone that he wants to bring inside the super-secret U.S. spy agency to access classified information and apps while on the move. He wants it to work as easily as any of the smartphones those that are so ubiquitous in the outside world.

That is no small vision for an agency where entire buildings are designated as Sensitive Compartmented Information Facilities, known as SCIFs in spy speak, with many restrictions to ensure the handling and discussion of secret information stays secure.

Visitors to the Fort Meade, Maryland, NSA complex are not allowed to bring outside cellphones into the building.

Lange argues that using smartphones inside areas that deal with secret material will increase efficiency.

"I want to get this into everybody's hands" -- every employee in the Defense Department, intelligence community and across government, he said, while acknowledging that kind of talk makes "the security people's heads pop off."

3,000 Intelligence officials' names, emails leaked as 'INSA spies'

computerworld.com
Last week, a "premier intelligence and national security organization" was hacked and then hundreds of intelligence officials, ranging from the NSA, FBI, CIA, the Pentagon, the White House, had their names, email addresses, some phone numbers and even home addresses posted on Cryptome.

Intelligence and National Security Alliance (INSA) published a Cyber Intelligence report [PDF] about the need to develop better cyber intelligence sharing, analysis and defenses against the "cyber threat environment" where hackers are cracking into everyone's systems, from government agencies to private companies. 48 hours later, a cyberattack was launched against INSA website and the membership list was leaked after the hack.

MSNBC reported that "in apparent retaliation, INSA's 'secure' computer system was hacked and the entire 3,000-person membership posted on the Cryptome.org." There were 95 email addresses belonging to the "supersecret National Security Agency, as well as scores of others in key positions at the White House, the Pentagon, FBI, CIA, the Office of Director of National Intelligence and the State Department." John Young who runs Cryptome said in a telephone interview with NBC that he had no reservations about publishing 'INSA Nest of Official and Corporate Spies.' Young said, "We would love to name every spy that lives on Earth."

NSA President Ellen McCarthy confirmed the leak is real and told MSNBC that exposed members are not happy about the published list of names and email addresses. "Intelligence people are not very fond of getting a lot of attention."

Appeals Court to Weigh NSA Dragnet Surveillance

wired.com

Whether the federal government and the nation’s telecommunication companies can be held accountable for allegedly funneling every American’s electronic communication to the National Security Agency without warrants is the subject of oral arguments scheduled for a federal appeals court Wednesday.

At issue is a Jan. 31, 2006 lawsuit, and others that followed, alleging violations of the Fourth Amendment right to be free from warrantless searches and seizures. The cases, about three dozen which will be consolidated into two oral arguments, have been thrown out of court on a variety of grounds, chiefly the government’s claim that the lawsuits would expose state secrets, and a 2008 law that immunized the nation’s telcos from such lawsuits.

Nearly six years later, the merits of the lawsuits have never been addressed. The Electronic Frontier Foundation, which brought the leading cases, appealed, and contends that the litigation should never have been dismissed.

The Espionage Act: Why Tom Drake was indicted

(CBS News)

Nearly two years before 9/11, America's largest intelligence agency was tracking three of the Al Qaeda hijackers. But that information, obtained by the National Security agency, wasn't analyzed in a way that could uncover the plot.

Inside the super-secret NSA, several analysts and managers believed that the agency had a powerful tool that might've had a chance to head off 9/11, but it wasn't used.

As Scott Pelley first reported in May, one of those agency insiders was Thomas Drake, who thought that taxpayer money was being wasted on useless intelligence gathering projects while promising technology was ignored.

Drake tried to get the word out but, as a result, he was charged under the Espionage Act and accused of betraying his country. Drake says that the only thing he betrayed was NSA mismanagement that undermined national security.

THE U.S. CONNECTION

mirror.co.uk

EXCLUSIVE: Chiefs mourn loss of 'genius'

The full extent of murdered spy Gareth Williams' role in the world of espionage slowly began to emerge last night.

He was rated as one of the best codebreakers in the business - an elite agent who fought in secret to thwart al-Qaeda terror attacks at home and abroad.

And the 31-year-old maths genius's unique skills were also recognized by spy chiefs across the Atlantic.

Despite a dislike of flying, he regularly traveled from London to Baltimore to meet US National Security Agency officials at their Fort Meade HQ - dubbed the Puzzle Palace.

He made the trip up to four times a year "on business" for the Government's GCHQ listening post.

Last night his uncle told how he would mysteriously disappear for up to three or four weeks at a time.

Speaking at his farmhouse at Anglesey, North Wales, Michael Hughes said: "The trips were very hush-hush. They were so secret that I only recently found out about them - and we're a very close family. It had become part of his job in the past few years. His last trip out there was a few weeks ago, but he was regularly back and forth."

Woman takes charge of major intelligence agency for the first time

cnn.com
Fort Belvoir, Virginia (CNN)
-- A chunk of the glass ceiling came tumbling down Monday as veteran national security officer Letitia "Tish" Long became the first woman to head a major intelligence agency.

Long, who has spent 32 years in government service, including more than two decades in the intelligence community, was sworn in as director of the National Geospatial-Intelligence Agency, the office responsible for collecting and analyzing overhead imagery and geospatial information.

The swearing-in took place at NGA's sprawling $1.7 billion, 2.4 million square foot complex in Fort Belvoir -- soon to the agency's new headquarters.

Sen. Dianne Feinstein, chairwoman of the Intelligence Committee, said the installation of a woman to run a spy agency with a multibillion-dollar budget and thousands of employees is a key milestone.

"This is an important appointment, and I hope that she will bring a new and determined management ability to this agency," Feinstein said.

3 Famous Spy Cases That Shaped The United States

In one form or another, spying and espionage have been going on as long as there have been groups of people who have an interest in keeping an eye on each other. Historical cases of spying and espionage have shaped the way in which The United States handles domestic and international crime fighting and security. The following are three influential cases that marked very important eras in US history:

1. The Atom Spy Case- The Rosenburgs
(http://www.fbi.gov/libref/historic/famcases/atom/atom.htm)
Russian-Americans Julius and Ethel Rosenburg were responsible for Soviet Russia's acquisition of the atom bomb. In a complex web of intrigue, the couple recruited David Greenglass, Ethel's brother, to obtain atom bomb schematics. A communist since the age of 14 and a member of the military, Greenglass was able to obtain the schematics. These were then passed on to the Russian intelligence agency in Moscow.

2. The Pearl Harbor Spy
(http://www.fbi.gov/page2/feb05/kuehn022105.htm)
German national Otto Kuehn was responsible for coordinating the attack of the Japanese fleet on Pearl Harbor. With a complex serious of signals—bed sheets being hung to dry at certain hours, lights lit in certain windows of his house, etc.— Kuehn was able to reveal the movements of specific Navy vessels and to prevent troop deployments. Five days before the December 7th, 1941 attack on Pearl Harbor, Kuehn sent a letter to the Japanese commander containing details concerning the US fleet.

In the aftermath of the Pearl Harbor attacks, Kuehn was found guilty of being a spy. Initially, he was sentenced to die by firing squad. Instead, he was sentenced to life in prison and then deported.

3. 1985 The Year of the Spy
(http://www.fbi.gov/libref/historic/famcases/year_of_the_spy/spy.htm)
In 1985, a notable number of high-profile individuals were arrested for spying. While the Cold-War was winding down, spying activities continued with great intensity. The following spies were apprehended during this year of high intensity espionage.

John Anthony Walker Jr. - US Navy Warrant Officer and Communications Specialist

Jonathan Jay Pollard - Civilian intelligence analyst at the Navy's Anti-Terrorist Alert Center in Maryland

Sharon Marie Scranage - CIA clerk stationed in Ghana

Larry Wu-tai Chin - Chinese language translator/intelligence officer for CIA, 1952 to 1981

Ronald William Pelton - Communications specialist, National Security Agency

Android App Aims to Allow Wiretap-Proof Cell Phone Calls

Forbes.com
Worried about the NSA, the FBI, criminals or cyberspies electronically eavedropping on your private phone calls? There may be an untappable app for that.

On Tuesday, an independent hacker and security researcher who goes by the handle Moxie Marlinspike and his Pittsburgh-based startup Whisper Systems launched free public betas for two new privacy-focused programs on Google's Android mobile platform: RedPhone, a voice over Internet protocol (VoIP) program that encrypts phone calls, and TextSecure, an app for sending and receiving encrypted text messages and scrambling the messages stored in their inbox.

Marlinspike says the apps will interface with users' contact lists and other functions on the phone to take the hassle out of making calls and sending texts that can't be eavesdropped by third parties. "Our main aim is to make this as easy as possible," he says. "We want it to be a secure and anonymous drop-in replacement for the normal dialing system on your phone."

USB Flash Drive Spy Cufflinks

cg

All Spies must have their data with them at all times! We want absolutely everything to be mobile and with us at all times. Which makes these flash drive cufflinks only the obvious next step. This pair of USB drives will let you keep all of your documents directly on your wrist. Plus you can keep two different sets, since you’ll have a drive on each wrist.

It will give you a total of 4GB worth of space to fill up, there’s 2GB on each of the drives. You can even have the shiny drive engraved. Should you not like the shiny look you can also pick up gunmetal and gold finishes. They are small enough that it’s unlikely that another spy will notice them.

Confessed Spy Convicted of Exporting U.S. Crypto Gear to China

wired.com

A Chinese national was convicted this week of smuggling and other charges over his efforts to acquire sensitive military and NSA-encryption gear from eBay and other internet sources.

Chi Tong Kuok, of Macau, told Defense Department and Customs investigators that he had been “acting at the direction of officials for the People’s Republic of China,” according to a government affidavit in the case. “Kuok indicated he and PRC officials sought the items to figure out ways to listen to or monitor U.S. government and military communications.”

Kuok was arrested at the Atlanta International Airport last year en route from Paris to Panama, where he planned to meet an undercover federal agent he believed was going to provide him with military radios. He was transferred to California and indicted (.pdf) for money laundering, conspiracy, smuggling and one count of attempting to export a defense article without a license. On Tuesday, a jury convicted him on all counts.

Cyberattack Drill Shows U.S. Unprepared

informationweek.com
A group of high-ranking former federal officials scramble to react to mobile phone malware and the failure of the electricity grid in a staged exercise.

"Cyber Shockwave," conceived and executed by the Bipartisan Policy Center along with experts in cybersecurity, simulated such an attack on Tuesday -- and discovered that the U.S. is ill-prepared to handle a large scale cyberattack.

In an effort to spur U.S. officials to take cybersecurity more seriously, Cyber Shockwave brought together a group of former high-ranking White House, Cabinet, and national security officials to see how they would deal with such a crisis in realtime.
Imagine what would happen if a massive cyberattack hit the U.S., crippling mobile phones and overwhelming both telephone infrastructure and the electricity grid.

Google Asks NSA to Help Secure Its Network

wired.com

Google is teaming up with the National Security Agency to investigate the recent hack attack against its network in a bid to prevent another assault, according to The Washington Post.

The internet search giant is working on an agreement with the controversial agency to determine the attacker’s methods and what Google can do to shore up its network.

Sources assured the Post that the deal does not mean the NSA will have access to users’ searches or e-mail communications and accounts. Nor will Google share proprietary data with the agency.

But the move is raising concerns among privacy and civil rights advocates.

The Electronic Privacy Information Center filed a Freedom of Information Act request on Thursday, shortly after the agreement was made public, seeking more information about the arrangement. (.pdf)
